Return, Refund and Cancellation Policy

This Return, Refund and Cancellation Policy explains your rights when purchasing products from our website. It applies to customers in Germany and, where applicable, other countries within the European Union and European Economic Area.

Nothing in this Policy limits or excludes any mandatory consumer rights available under German or European Union law.

2. Statutory 14-Day Right of Withdrawal

Consumers purchasing products online generally have the right to withdraw from the purchase contract within 14 days without providing a reason.

The withdrawal period begins on the day when you, or a third party nominated by you other than the delivery carrier, receives the product.

If one order contains several products delivered separately, the withdrawal period begins when the final product from that order is received.

To exercise your right of withdrawal, you must send us a clear statement confirming your decision to withdraw from the contract before the 14-day withdrawal period expires.

3. Returning Products After Withdrawal

After notifying us of your decision to withdraw, you must return the products without unnecessary delay and no later than 14 days after the date on which you informed us of your withdrawal.

Before returning any product, please contact info@mkminy.shop to obtain the correct return instructions and authorized return address.

Do not send products to the address shown on the original shipping parcel unless our customer service team has confirmed in writing that it is the correct return address. Products sent to an unauthorized address may be delayed, refused, lost, or returned to the sender.

The return deadline is met when you send the products before the 14-day return period expires.

4. Return Shipping Costs for Change-of-Mind Returns

Where a return is made under the statutory right of withdrawal and the product is not defective, damaged, incorrect, or otherwise non-conforming, you are responsible for the direct cost of returning the product.

We recommend using a tracked and insured shipping service and keeping the shipping receipt and tracking information until your return and refund have been completed.

We are not responsible for return packages that are lost or damaged because they were inadequately packaged or sent without an appropriate shipping service.

This section does not apply where the product is defective, damaged, incorrect, or not as described. In those circumstances, we will bear the reasonable and necessary return shipping costs.

5. Condition of Returned Products

You may inspect a product in the same way that you would reasonably inspect it in a physical retail store.

You may be responsible for any reduction in the product’s value resulting from handling that goes beyond what is necessary to establish the product’s nature, characteristics, and functionality.

Where reasonably possible, returned products should include:

  • The original product
  • Accessories and included parts
  • Product instructions or manuals
  • Original labels and tags
  • Original packaging
  • Promotional items included with the order

The absence of original packaging alone does not automatically remove your statutory right of withdrawal. However, you may be responsible for a reduction in value where excessive handling, damage, use, missing parts, or inadequate packaging has reduced the product’s resale value.

Products should not be intentionally damaged, altered, contaminated, washed, extensively used, or returned with missing components.

6. Refunds Following Withdrawal

When you validly exercise your right of withdrawal, we will refund payments received from you for the returned products.

The refund will include the cost of the least expensive standard delivery method offered by us for the original order.

If you selected an express, premium, priority, or other delivery method that was more expensive than our least expensive standard delivery option, the additional delivery cost will not be refunded.

We will issue the refund without unnecessary delay and no later than 14 days after receiving your withdrawal notice.

However, we may withhold the refund until:

  • We have received the returned products; or
  • You provide satisfactory evidence that the products have been returned,

whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction, unless another method has been expressly agreed and does not result in additional fees for you.

The time required for the refunded amount to appear in your account may depend on your bank, card issuer, or payment service provider.

7. Products Excluded From the Right of Withdrawal

The statutory right of withdrawal may not apply to certain products where an applicable legal exception exists.

These exceptions may include:

  • Products made according to the customer’s individual specifications
  • Personalized or custom-made products
  • Products clearly tailored to the customer’s personal requirements
  • Products that may deteriorate or expire rapidly
  • Sealed products that are unsuitable for return for health-protection or hygiene reasons after the seal has been removed
  • Products that become inseparably mixed with other goods after delivery
  • Sealed audio recordings, video recordings, or computer software after the seal has been removed
  • Digital content supplied without a physical medium after performance has begun with the customer’s prior express consent and acknowledgement that the withdrawal right will be lost

An exception will only be applied where the legal conditions for that exception are satisfied.

Products will not be excluded from statutory rights merely because they were discounted, included in a promotion, or marked as a sale item.

8. Damaged, Defective, Incorrect, or Non-Conforming Products

Please inspect your order after delivery.

  • Is defective
  • Is materially different from its description
  • Does not function as reasonably expected
  • Is the wrong product, colour, size, or quantity
  • Is missing essential components
  • Otherwise fails to conform to the purchase contract

Please provide your order number and a description of the problem. Photographs or videos may help us investigate the issue more quickly, but requesting supporting evidence does not limit your statutory consumer rights.

Do not dispose of, repair, alter, or return the product before receiving instructions from us, unless doing so is reasonably necessary to prevent additional damage or risk.

9. Legal Rights for Defective Products

Customers in Germany and the European Union benefit from mandatory legal rights where products are defective or fail to conform to the purchase contract.

For new consumer goods, the statutory conformity period is generally at least two years from delivery.

Depending on the circumstances and applicable law, you may initially be entitled to request:

  • Repair of the product; or
  • Replacement of the product

Repair or replacement will be provided within a reasonable period, without significant inconvenience, and without charging you the necessary transport, labour, or material costs.

Minor defects may not always justify cancellation of the entire contract, but other statutory remedies may remain available.

These rights exist independently of any voluntary commercial warranty offered by a manufacturer or other third party.

10. Return Costs for Defective or Incorrect Products

Where a product is defective, damaged, incorrect, or otherwise non-conforming, we will bear the reasonable and necessary cost of returning the product.

Depending on the circumstances, we may provide:

  • A prepaid return label
  • A return shipping reimbursement
  • A collection service
  • Alternative return instructions

Please obtain authorization before arranging a return. We may not reimburse unnecessarily expensive shipping methods where a reasonable return option was available.

11. Products Damaged During Delivery

If the external packaging or product appears damaged at delivery, please document the condition where reasonably possible.

12. Missing or Incorrect Items

If an item is missing from your order or you receive an incorrect item, contact us at info@mkminy.shop.

Please do not use, remove labels from, or dispose of an incorrectly delivered product before receiving instructions from us.

After reviewing the matter, we may arrange delivery of the correct product, replacement of the missing product, collection of the incorrect product, or an appropriate refund.

13. Order Cancellations Before Dispatch

To request cancellation of an order before dispatch, contact us as soon as possible at:

Please include your order number and clearly state that you wish to cancel the order.

We will make reasonable efforts to process the cancellation. However, cancellation cannot be guaranteed once an order has entered fulfilment, packing, or shipping.

If the order has already been dispatched, you may exercise your statutory right of withdrawal after receiving the order, subject to the conditions and exceptions described in this Policy.

14. Refused and Unclaimed Deliveries

Refusing delivery or failing to collect a package does not necessarily constitute a valid withdrawal notice.

You should notify us clearly at info@mkminy.shop if you wish to withdraw from the purchase contract.

Where an order is returned because:

  • The delivery was refused
  • The delivery address was incomplete or incorrect
  • The package was not collected
  • Delivery attempts were unsuccessful for reasons attributable to the customer

we may deduct reasonable direct costs resulting from the failed delivery or return, where permitted by law.

This section does not apply where the delivery failure was caused by us or the carrier.

15. Exchanges

We may not always be able to offer direct exchanges.

Where an exchange service is unavailable, you may return the original product in accordance with this Policy and place a new order for the preferred product.

Your statutory rights concerning defective or non-conforming goods remain unaffected.

16. Promotional Products and Gifts

If a free promotional product or gift was provided only because the original order met specific promotional conditions, it should normally be returned when the entire qualifying order is returned.

If the promotional item is not returned, we may deduct its reasonable value from the refund where legally permitted and where the promotional conditions were clearly disclosed.

17. Partial Returns

You may return individual eligible products from an order without returning the entire order.

For partial returns, the original standard delivery charge will only be refunded where required by applicable law. If you keep part of the order and the original delivery service would have cost the same for the retained products, the original delivery charge may not be refundable.

18. Refund Adjustments

A refund may be reduced where legally permitted if:

  • The product has been handled beyond what was necessary to inspect it
  • The product has been damaged by the customer
  • Parts or accessories are missing
  • The product’s value has been reduced through excessive use
  • Promotional items that were required to be returned are missing
  • Reasonable costs resulted from an unauthorized or failed delivery

We will not make arbitrary deductions. Where a refund is reduced, we will provide an explanation of the reason and amount.

19. Unauthorized Returns

Products returned without first contacting us may be difficult to identify or process.

An unauthorized return does not automatically remove statutory consumer rights, but it may delay processing and may result in additional costs where the product is sent to an incorrect address.

20. Refund Processing Errors

If you have received a refund confirmation but the amount has not appeared in your account, please:

  1. Check the original payment account used for the order.
  2. Contact your bank, card issuer, or payment service provider.
  3. Allow for the provider’s normal processing time.

We will review the transaction and provide available refund confirmation information.

21. No Limitation of Statutory Rights

This Policy does not limit, replace, waive, or exclude any mandatory rights available to consumers under German law or European Union consumer protection law.

Where any provision of this Policy conflicts with mandatory law, the mandatory legal provision will apply.
